How It Works
Pre-Filing Review
We review your mark, target goods or services, and Nice classification strategy. If a clearance search was not done previously, we recommend one.
Application Drafting and Filing
We draft the application with optimized goods and services descriptions, then file online with CIPO. You receive your filing receipt and application number.
Examination and Office Actions
We monitor examination, respond to any Office Actions within the six-month deadline, and keep you updated on status throughout.
Registration
Once your application is allowed and the registration fee paid, your registration certificate issues. We add the 10-year renewal to our calendar.
Frequently Asked Questions
How much does it cost to register a trademark in Canada in 2026?
Canadian trademark registration costs have two components. The CIPO government filing fee is $491.06 for the first class of goods or services, plus $149.04 for each additional class (online filing rates). Onley Law professional fees are quoted as a fixed fee per class based on scope. Contact us for a fixed-fee quote within one business day.
How long does Canadian trademark registration take?
A typical unopposed Canadian trademark application takes 24 to 36 months from filing to registration. CIPO examination alone takes 18 to 24 months in most cases. Applications that receive Office Actions or face opposition take longer. We provide milestone estimates as part of every engagement.
What is included in your trademark registration service?
Our standard scope includes the pre-filing review, application drafting and online filing with CIPO, examination monitoring, one Office Action response (if any), and registration certificate management. Opposition defence, additional Office Action responses, and post-registration renewals are scoped and quoted separately.
Do I need to file in multiple Nice classes?
Possibly. The Nice Classification system has 45 classes. You should file in every class that covers a current or near-term business activity. Filing in too few classes leaves gaps; filing in too many wastes filing fees and risks abandonment for non-use. We recommend specific classes as part of the pre-filing review.
What happens if my application is opposed?
Opposition is filed at the Trademarks Opposition Board (TMOB) after your mark is advertised in the Trademarks Journal. You have a deadline to file a counter-statement and the proceeding moves through evidence, argument, and (if needed) a hearing. Opposition defence is quoted separately from the registration engagement; see our Trademark Opposition service.
Can I file a trademark application myself in Canada?
You can file your own application if you reside in Canada and the application is in your own name. But you cannot have a non-agent (including a general lawyer) prosecute on your behalf at CIPO. Most do-it-yourself applications run into preventable Office Actions due to suboptimal goods and services drafting or class selection. Our pre-filing review prevents most of these.
